In the days since Canada passed the Canadian Anti-Spam Legislation, or CASL, it has been more difficult to build a good email marketing list that remained CASL compliant.

As you can see, the form indicates both consent and the date in which it was obtained. It is vital that companies have this information on file as the consequences for violating CASL are significant. They can include fines ranging from $1m to $10m per violation. It’s important to note that individuals and companies, including directors, officers and other agents, are responsible and liable for the messages they send.
So, you don’t want run afoul of CASL.
Since July 1, 2017 CASL has required companies to obtain express consent before contacting people. Express consent means that a person has clearly agreed — orally or in writing — to receive a commercial electronic message. It is not time-limited, unless the recipient withdraws his or her consent.
